Professor's Work on Race, Ethnic Defamation Published

An article on race and ethnic group defamation by Professor Michael Polelle of The John Marshall Law School in Chicago has been selected as one of 13 articles being published in the 2004-2005 collection, "First Amendment Law Handbook."

Polelle's piece, titled "Racial and Ethnic Group Defamation: A Speech-Friendly Proposal," was originally published in 2003 in a college law review.

It outlines the need for a declaratory judgment statute at the state level to remedy group racial and ethnic defamation.

"The fundamental paradox of contemporary American defamation law is that unlike other countries, we provide a remedy for individual defamation, but practically speaking, none for racial or ethnic defamation," the professor explains. "The lesson for the defamer is to lie largely."

Polelle was co-counsel to the American Italian Defense Association (AIDA) when it filed its lawsuit in Illinois against Time Warner Entertainment Co. for its television production "The Sopranos." The court refused to act on AIDA's argument that the show's depiction of Italian-Americans violates the "individual dignity" clause of the Illinois Constitution.

Polelle argues that the law should provide a remedy for racial and ethnic group defamation. Groups taking action in court are consistently denied damages. Polelle says the courts have refused to recognize the individual harm caused by group defamation. Criminal defamation statutes are on the books in fewer than half the states, and are rarely used by prosecutors, he notes.

His article was considered among the best articles on the First Amendment published in the 2003-2004 years. This will be West Publishing/Thomson Company's 15th issuance of its First Amendment annual series.

The 2005 volume focuses on First Amendment theory, defamation, symbolic speech, censorship and children, copyright, right of publicity and First Amendment history. It is designed to acquaint lawyers and other professions affected by the First Amendment.
