Irish Attorneys Learn Techniques In Trial Advocacy Program

They're already attorneys, but coming to The John Marshall Law School for the Accelerated Trial Advocacy Program gave two Irish barristers and a solicitor new insights into handling and arguing a case.

For the fifth year, John Marshall has invited a select group of Irish attorneys to come to Chicago for the 10-day program. This year's guests were Christina Ryan who earned a law degree and master's degree in European and International Law from Trinity College-Dublin, and is preparing at the Honorable Society of Kings Inns to serve as a barrister; Michael Finucane, originally from Belfast who has been a solicitor in Dublin for two years; and Derek Sheahan of Limerick who has been practicing in the Four Courts in Dublin and the Western Circuit for two years.

"We don't get any instruction in trial work, and there are overlaps (between Irish and American law) in how to work a case and present a case that we get from your program," Sheahan said. He is doing commercial law now, but Sheahan said the John Marshall program gave him serious thoughts about taking on criminal and defamation cases, which are argued before juries.

"The course was interesting and quite useful," Ryan added.

"There are differences to how the courts and trials are run, but the skills are the same. This program is very hands-on. In Ireland, your hands-on experience is when you're down in the courts. Once you're a barrister, you're in court right away, so there's no practical experience."

For Finucane, a solicitor, the interest in the Accelerated Trial Advocacy Program was the preparation of a case for trial. In Ireland, a solicitor prepares the case and then turns it over to a barrister to argue it in court.

"The relationship of solicitor/barrister is symbiotic," Finucane explained, although solicitors are starting to do court work.

Finucane has already argued cases as a public interest and human rights lawyer. He has been a criminal defense attorney for Northern Ireland prisoners, and also argued a case before the European Court of Human Rights in Strasbourg.

The Accelerated Trial Advocacy program was begun in the mid-1980s. Today it is run by the Center for Advocacy and Dispute Resolution. This year's August class included 80 students, said Professor Kenneth Kandaras, who is center director.
