November Conference Addresses Veterans' Medical and Legal Issues

A large number of veterans are returning from Iraq and Afghanistan with serious physical and mental disabilities. The full extent of these injuries may not be manifested for many years. Due to advancements in medicine, both on the battlefield and at home, service members have survived injuries that even a decade ago would have been fatal. Consequently, they will require extraordinary future care, both in rehabilitation and medical services. As many of those wounded may live another 50 years, it is imperative that their needs be addressed, in terms of treatment and benefits.

On Friday, Nov. 7, and Saturday, Nov. 8, 2008, The John Marshall Law School Veterans Legal Services Center & Clinic is hosting a conference at the law school, 315 S. Plymouth Ct., focusing on how the legal and medical professions can work together to better serve our nation's veterans. The conference is sponsored by a generous donation by the McCormick Foundation.

Among the goals of this conference are educating the legal and medical professions by developing efficiencies and improving the quality of the services given to our nation's veterans, and developing best practices and enhancing coordination between the legal and medical professions.

The two-day program begins Nov. 7 at 8 a.m. with participant sign-in.

Tammy Duckworth, director of the Illinois Department of Veterans Affairs will give the welcoming address. The luncheon keynote speaker is Illinois Lt. Gov. Pat Quinn.

Additional panelists for Friday's program will address "Transitioning from the Military to the VA," "Battlefield Medicine," "Traumatic Brain Injury" and "Emerging Issues."

Friday's sessions will end with a 5:30 reception at the Union League Club in Chicago.

Saturday's program begins at 9 a.m. and panelists will discuss "Law School Veterans Clinics" and "Forging a Relationship Between Doctors and Lawyers." The program concludes at 1 p.m.

This program has a $125 fee that includes lunch and the Nov. 7 reception. Upon completion, participants also will receive 10 hours of CLE credit. The registration deadline is Oct. 24. For more information, visit www.jmls.edu/veterans.

Illinois VA Attorney Addresses Veterans Advocacy Class

During a recent session of the Veterans Advocacy class, guest speaker Henry Nolan, special assistant to the general counsel for the Illinois Department of Veterans Affairs, spoke about the Departments of Defense (DoD) and Veterans Affairs (VA) Disability Evaluation System. He focused on the improvements being made to the departments, the joint DoD and VA oversight structure and some of the other initiatives that DoD and VA are implementing in order to smooth the transition of wounded, ill and injured service members from active duty to veteran status.

Fair Housing Legal Clinic Wins Settlement in FHA, Zoning Case

The John Marshall Fair Housing Legal Clinic successfully negotiated a settlement Sept. 18, 2008 under the Fair Housing Act, with the Village of Indian Head Park that will allow a disabled child to play in a fenced-in back yard at her home.

The family of eight-year-old Emily Pall, a child with Down syndrome, argued that they needed to fence in their yard to provide Emily with a beneficial play area while providing her with physical boundaries for her safety. The Village of Indian Head Park restricts fences within their village, and denied the request for a variance that would allow the family to build the fence. The clinic represented the family and filed for declaratory and injunctive relief and damages on July 3, 2008, in U.S. District Court.

Michael and Mary Pall, and their daughter were represented by Fair Housing Legal Clinic Supervising Attorney James Clifton Whiteside who worked with students Donte Brown, Marcy Bennett, Anthony Drew and Anais Hervieux in drafting the July complaint for a reasonable accommodation.

Brown, Bennett, Drew, Hervieux and student Joel Knosher filed several pre-trial motions and conducted discovery. Knosher had the opportunity to depose the mayor of Indian Head Park, and he and Hervieux participated in a settlement conference before Judge Martin C. Ashman at the Federal Courthouse.

The settlement agreement allows the Palls to construct a fence around their yard. The village of Indian Head Park also will amend its municipal code to further future compliance with the Americans with Disabilities Act, the Fair Housing Amendments Act, and Section 504 of the Rehabilitation Act of 1974.

"The settlement is a tribute to the many hours put in by the students on the Pall case, led by supervising attorney James Whiteside," said Allison Bethel, director of the clinic.

Barlow Named 2008 Lawton Scholar

Maria Barlow, a third-year student at The John Marshall Law School, has been selected the 2008 recipient of the Samuel T. Lawton Jr. Memorial Scholarship.

"This scholarship is a wonderful gift and I thank the selection committee for naming me the recipient," Barlow said. "I am looking forward to my career in law and I hope that I can emulate, in some small way, the fine lawyering skills that Professor Lawton gave to his work each day."

The scholarship was established in honor of Adjunct Professor Samuel T. Lawton Jr., who taught at The John Marshall Law School for almost 50 years until his death in 2003. Student recipients are selected based on academic standing and an interest and background in environmental, government, local or public service law, areas to which Lawton devoted his career. Lawton was appointed to the Illinois Air Pollution Control Board and was appointed to the original board by Gov. Richard Ogilvie when Illinois passed its first Environmental Protection Act in 1970. Lawton also served on numerous local government boards and commissions, and his private practice also focused on environmental and local government law as well.

This year, Barlow is serving as president of the Black Law Students Association, and is vice president of the Criminal Law Society. She is a member of the Women's Law Caucus and serves as its diversity chairperson. Barlow, a graduate of Chicago's Kenwood Academy and Northeastern Illinois University, splits her work hours between the Cook County State's Attorney's Office and the City of Chicago Department of Law, Municipal Prosecutions.

She is hoping to work in public service law after her graduation.Barlow and her son, Jaden, live in Chicago's Calumet Heights neighborhood.

Faculty Scholarship Roundtable Speaker

Professor Alberto Bernabe (left) and Associate Dean Ralph Ruebner (right) welcomed Professor David Wexler to The John Marshall Law School on Oct. 7 as the second speaker for the Faculty Scholarship Roundtable Series. Wexler, the Distinguished Research Professor of Law at the University of Arizona, James E. Rogers College of Law, addressed "Therapeutic Jurisprudence and the Criminal Defense Lawyer." The program was organized by Bernabe.

The Native American and Indigenous Students Association will meet at noon in room 300. Judge Richard Ackley of the Bad River Band of Lake Superior Chippewa will be speaking about tribal law. Lunch will be served.

The Entertainment Law Society will meet at 5 p.m. in the student lounge.

The Federalist Society will host speaker, Ted Frank, who will speak about video game law, Supreme Court appointments and the Supreme Court ruling on hand guns in Room 201 at 4:30 p.m.

The Criminal Law Society is having "Happy Hour" at Plymouth Restaurant.

The Student Bar Association will meet at 5 p.m. in room 216.

October 18

The Black Law Students Association mentor reception will be held at 11 a.m. in room 3 East.

She was a guest instructor for an Illinois Institute of Continuing Legal Education (IICLE) class covering the law and strategies for employers to avoid legal pitfalls relative to employee discipline and termination.

She wrote the chapter, "Employment Discrimination and Discharge" for the new book Employment Termination published by IICLE.

Professor William Ford

Activities

He was a guest presenter at the 2008 Works-In-Progress Intellectual Property Conference on "The Copyrightability of Games." The program was Oct. 3 and 4 at Tulane University School of Law.

Professor Samuel Jones

Activities

He participated in the Legal Education at the Crossroads - Ideas to Accomplishments: Sharing New Ideas for an Integrated Curriculum Conference hosted by the Washington University School of Law, Sept. 5 through 7, 2008.

He was a commentator and moderator at the Northeast People of Color Legal Scholarship Conference hosted by Boston University School of Law, Sept. 11 through 13, 2008.

He participated in the 13th Annual Latina and Latino Critical Legal Theory Conference, hosted by Seattle University School of Law, Oct 3 through 5, 2008.

He coaches John Marshall's team for the Frederick Douglass Moot Court Competition hosted by the National Black Law Students Association.

He accepted an invitation to address "Detainees, Interrogations and Military Commissions" at The Rule of Law and Global War on Terrorism Symposium hosted by Washburn University School of Law in November 2008. The invitation includes an offer to publish an article in the Washburn University School of Law's Washburn Law Journal spring/summer 2009 publication.

Publications

Professor Jones accepted an offer of publication from Boston University School of Law's American Journal of Law and Medicine (peer review) for his article, "When Law and Morality Collide: Sleep Deprivation and the Good Faith Performance of Resident Physician Contracts."

Professor Colin Miller

Publications

His article, "Impeachable Offenses?: Why Civil Parties in Quasi-Criminal Cases Should be Treated Like Criminal Defendants Under the Felony Conviction Impeachment Rule," accepted for publication in the Pepperdine Law Review.

Professor David Schwartz

Activities

He was an invited speaker for the 2008 Works-In-Professor Intellectual Property Conference at Tulane University School of Law Oct. 3 and 4. His presentation topic was "An Empirical Study of Claim Construction Reversal Rates Across Technologies."
