John Marshall Team Takes 6th Place, Named "Most Effective Team" at International Meet

The John Marshall Law School team of Dan Padernacht and Curtis Vosti took sixth place at the International Negotiation Competition for Law Students in Singapore, and were named "Most Effective Team" during one of the three rounds.

The team represented the United States and competed against 15 other teams representing Australia, Canada, Denmark, England and Wales, Hong Kong, Japan, India, Ireland, New Zealand, Northern Ireland, Puerto Rico, Singapore, South Korea and Sweden.

"I was filled with a magnanimous sense of pride in knowing that of all the schools in the country, John Marshall represented the United States in this competition," Padernacht said.

They were accompanied by their coach, Adjunct Professor Dawn Bode, and Professor Kenneth Kandaras, director of the Center for Advocacy and Dispute Resolution. "Their insight, reflection and presence were invaluable," Padernacht noted.

The team advanced to international competition after successfully competing in the American Bar Association's regional competition and advancing to national competition in Miami in February. Padernacht and Vosti ended the preliminary rounds with a perfect score and advanced to the final four teams. The team was awarded second-place national honors and received their invitation to the Singapore competition.

"The best experience of the competition was going up against top-notch student negotiators from around the world, and finding we more than held our own," said Vosti.

"The techniques, timing and tactics we learned during months of instruction from the trial advocacy staff _especially our coach, Adjunct Professor Dawn Bode—proved superior in many ways and made for life-affirming, never-to-be-forgotten experiences in Chicago, Miami and, now, Singapore on the other side of the globe!" he added.

Padernacht said the style of the competition was different from what he and Vosti were used to. They quickly learned that negotiating contracts in the United States is not like negotiating in other parts of the world.

"Here, you would be as direct as possible to avoid future problems," Padernacht explained. In Asia, however, the team realized that direct isn't always the tenor for negotiations. He and Vosti quickly learned that "if somebody doesn't want to answer something right off the bat, another culture might ease around it."

The first round of the international competition required four teams to negotiate the "loaning" of animals among four entities for purposes of preservation, bio-diversification and propagation of certain animal species.

The John Marshall team received separate recognition for maximizing client point value in the first round of the competition, and in the second round they were voted by the panel of judges as the "Most Effective Team." The team received high marks in each of the three rounds in recognition of their extensive preparation.

Several John Marshall professors, adjunct professors and students assisted the team with research, preparation and practices prior to their departure, including Professors Molly Lien, Karen Halverson Cross, Walter Kendall, Ardath Hamann and Mark Wojcik. Adjunct faculty members Christopher Markey, Michael Schlesinger, Cliff Scott-Rudnick and Center Associate Director Susann MacLachlan also participated in practice sessions with the team members. 

John Marshall alumni Ian Bucciarelli and Leonard Hudson and students Luke Hajzl and Rebecca Rose were also instrumental in the team's preparation.

"This experience would not have been possible without the support of the John Marshall community. To prepare for the competition, several professors and students dedicated their time to simulate actual negotiations. This provided us with the experience of encountering different negotiation styles," Padernacht explained.

He was one of 18 participants in the 2007 Silberman Seminar for Law Faculty, organized by the United States Holocaust memorial Museum's Center for Advanced Holocaust Studies. The 2007 seminar was "The Impact and Legacy of the Holocaust on the Law."

Publications

Her article, "PPA '06 Makes IRA Rollovers More Attractive: Maybe It's Time to Switch to a Self-Directed IRA? Think Again!," was published in 35 Tax Mgmt Plann. J. 211 (July 2007). This was the paper that she presented at the May 2007 Tax Management Advisory Board Meeting in New York City. She also completed the 7th edition of the BNA Tax Management Portfolio, 358-7th T.M., IRAs, SEPs and SIMPLEs, which will be published in the fall of 2007. BNA is one of the most respected publishers of print and electronic news, analysis, and reference products regarding tax and benefits issues.

Professor Ann Lousin

Activities

On April 20-22, 2007 she attended the annual meeting of The Armenian Bar Association in Santa Monica, CA, where she was re-appointed Chair of the Genocide Research Project Committee.

On April 23, 2007, she and Professor Leslie Reis attended the concluding meeting of The Chicago Bar Association's Task Force on Judicial Privacy, of which both have been members for three years.  The project produced a handbook for federal and state judges suggesting ways they could protect their privacy and safety.

On June 9, 2007, at the annual meeting of The Blind Service Association of Chicago, she was re-elected to two-year terms as a director and as executive vice president.

On June 12, 2007, she made a presentation to the Public Affairs Committee of The Union League Club.  She is co-chair of the Subcommittee on a Constitutional Convention, and made the presentation on behalf of the subcommittee. She recounted the histories of the referenda in 1968 and 1988 on holding a convention and analyzed the issues facing the electorate when voting on the issue in 2008. Among those joining her was Professor Ronald C. Smith, a former delegate to The Sixth Illinois Constitutional Convention.

Publications

Her article, "400 years of the common law", appeared in the April 26, 2007 issue of The Chicago Daily Law Bulletin. It commemorated the arrival of the common law with the Jamestown settlers in 1607.  Among those sending her letters of congratulations was a downstate lawyer who is a relative of Stephen A. Douglas, whom she quoted in the article.

New President for Board of Trustees, Five Appointed Board Members

The John Marshall Law School Board of Trustees has elected a new president and is welcoming five new members.

Beginning in September, the board will be led by a new president, Leonard Amari (J.D. '68), founding partner of Amari & Locallo. Other board officers will be Vice President Claireen Herting (J.D. '60) of Pricewaterhouse Coopers; Treasurer Ronald Riskin (J.D. '77), president of Pacific Commonwealth Corp.; and Secretary Dixie Lee Peterson (J.D. '75), Legal Services deputy director, Chicago Headquarters, Children and Family Services Department, State of Illinois.

Amari will serve as board president for one year. His appointment begins in September. He succeeds Alfred E. Gallo who has served as board president since 2000. He has been a member of the board since 1970. Gallo will continue as a trustee and serve on the board's Executive Committee. He will be given the title president emeritus.

After graduating from The John Marshall Law School, Amari was in private practice from 1968 to 1974 before accepting the position of general counsel to the Office of the Cook County Assessor. Amari held that position for five years before becoming a special assistant in the Illinois Attorney General's Office. In 1987, he joined with fellow John Marshall alumnus Joseph Locallo, Jr. (J.D. '76) to form Amari & Locallo. The firm focuses on real estate tax assessment issues.

Amari has been a John Marshall trustee since 2000. He also has served the legal community as president of the Illinois State Bar Association; a member of the Chicago Bar Association's State and Local Taxation Committee; and is a member and past president of the Justinian Society of Lawyers. He has received numerous honors from organizations recognizing his service.

The board also welcomes five new trustees who will serve three-year terms: Joseph Birkett (J.D. '81), DuPage County state's attorney; Umberto Davi (J.D. '82), an attorney in private practice; James Durkin (J.D. '88), a member of the Illinois House of Representatives; Mary Ann Hynes (J.D. '71, LL.M. '75), vice president and general counsel for Corn Products, Inc.; and Nancy Lee Johnson, a former member of the U.S. Congress whose grandfather, Edward T. Lee, was one of the founders of The John Marshall Law School. Her father, Noble T. Lee (J.D. '23), succeeded his father as dean of the law school.

In other business, board member Joseph Domitrz was appointed a member of the Executive Committee, and William Bates (J.D. '89) resigned from the board. Also stepping down were trustees Thomas Durkin, Hon. Wilson Frost and Hon. Mary Ann McMorrow, who were extended emeritus status.

John Marshall Hosts Chinese Patent Examiners

At a farewell dinner, 25 examiners from China's State Intellectual Property Office Reexamination Board and Patent Cooperation Center wear their John Marshall Law School T-shirts. The attorneys completed a short course in intellectual property at the law school and visited the offices of Mayer Brown Rowe & Maw. The group also traveled to Washington, D.C. for meetings at the U.S. Patent and Trademark Office and U.S. Court of Appeals for the D.C. Circuit, and a visit to the offices of Skadden Arps Slate, Meagher & Flom LLP in New York City. They were accompanied by Dorothy Li, co-director of the Asian Alliances Program. Joining them at the dinner are Adjunct Professor Vangelis Economu (back row, center left) and Professor David Schwartz (back row, center right).
