Ernest Melichar, director of Planned Giving for
The John Marshall Law School Foundation, received the Liberty
Award from the Bohemian Lawyers Association for his work in
the Chicago and Czech legal communities.
Shortly after joining the law school's staff,
Melichar began work on an initiative through the American Bar
Association's (ABA) Europe and Eurasia Division, also known as
CEELI. The program was designed to help countries formerly
behind the Iron Curtain learn about "rule of law" and develop
programs that would help foreign lawyers learn from their
counterparts in the United States.
Melichar, whose parents were from the Moravia
Province of the Czech Republic, spoke Czech as his first
language. His bilingual skills have been put to good use as
he's developed several Czech joint projects for The John
Marshall Law School.
As he recalled, it was a 1992 ABA-sponsored
summer trip by Professor Ann Lousin and alumnus Joseph Vosicky
(J.D. '81) that led to John Marshall's first Czech contact.
While in Prague and Bratislava, they met several people,
including Vojtech Cepl, dean of the Charles University Law
School. In December, Professor Michael Seng was invited to a
reception at the University of Chicago for Cepl.
After that meeting, Seng decided John Marshall
should work with the ABA on its Eastern European initiatives.
He asked Melichar to make the initial contacts.
"It turned out there were five law schools in
what was Czechoslovakia at the time," Melichar recalled. "The
only law school not already affiliated with an American school
was Masaryk University Faculty of Law, so I made arrangements
for the dean, Jiri Kroupa, to come to John Marshall."
Kroupa's itinerary included visits to local and
federal courts, a trip to Springfield for a look at the
Illinois Legislature and Supreme Court in session, visits to
classes at John Marshall, discussions with professors and
meetings with various Bohemian lawyers in the Chicago area.
At Kroupa's meeting with members of the Bohemian
Lawyers Association, George Drost got up and announced that
his father, John, was a graduate of Masaryk University before
coming to the United States and eventually enrolling at John
Marshall where he earned a law degree in 1961.
From that initial meeting, the Czech programs
gained major support from the Drost family, and the Beart
family. Robert Beart received his patent training from John
Marshall, and his granddaughter, Julia Drost-Hibler, received
her J.D. in January 2007, Melichar explained.
The John Marshall Law School's programs with
Czech institutions have been continuous since that 1993 visit
by Masaryk's dean. That visit blossomed into the Czech/Slovak
Law Program that consists of the annual Czech Study Tour to
the Czech Republic for alumni, lawyers and friends of the law
school to study new developments in Czech law and politics.
John Marshall has worked with the Czech Bar Association in
Prague since 1996 on an annual conference on American law.
John Marshall also established the Czech Student
Exchange that has brought more than a dozen students from
Masaryk University in Brno to John Marshall for a semester of
study in Chicago. One Czech student, Radim Charvat, returned
to John Marshall to earn his LL.M. degree in intellectual
property law.
In the summer 2005 semester, Seng organized the
first study abroad program to the Czech Republic for John
Marshall students. During the 2006 trip, 10 J.D. students took
courses on European law and the European Union in Prague and
in Brno. One of the guest lecturers was Charvat.

He authored the introductory note to the Israel
Supreme Court decision in Public Committee Against
Torture in Israel v. The Government of Israel, 46 I.L.M. 373
(2007), published by the American Society of International
Law. The Israel Supreme Court ruled in December 2006 that the
targeted killings of terrorists and bystanders could not be
pre-determined to violate customary international law, nor
could those killings always be said to be permitted under
international law. Instead, the Israel Supreme Court ruled
that the legality of targeted killing must be determined
in each individual case.
